Terms of Service

1. About the platform

Legit Bape is an online marketplace operated by K-DEV Solutions LLC where users can buy and sell authenticated clothing and accessories. Every listing is photo-reviewed by our expert team before going live. K-DEV Solutions LLC acts as an intermediary facilitating transactions between buyers and sellers — K-DEV Solutions LLC is not the seller of the items listed on the platform.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. If we discover that a user is under 18, we reserve the right to immediately delete their account.

3. Your account

• You must provide accurate, complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You may not create accounts for others, transfer accounts, or create a new account after suspension without express authorization.
• Report any suspicious activity on your account immediately to: support@marketplace.com
• You may close your account at any time through your account settings.
• We reserve the right to close accounts inactive for more than 365 days after email notification.

4. Listing and selling

• Sellers must provide accurate photos and descriptions of items. Misrepresentation may result in account suspension.
• All listings are subject to our photo-based legit check review. Items that fail authentication are rejected and will not be listed.
• Listings must comply with all applicable laws. Counterfeit items, stolen goods, and prohibited items may not be listed.
• Listing an item is free. A 4.99% commission is deducted from the sale price when an item sells.
• Sellers ship directly to buyers. Sellers are responsible for shipping costs and must use a tracked shipping service.
• Payouts are initiated within 3 business days after confirmed delivery via Stripe Connect.

5. Buying

• All items displayed on the platform have been photo-reviewed by our authentication team.
• A 4.99% authentication fee is added to the item price at checkout. Payment processing fees are handled by Stripe.
• Prices are displayed in USD. International buyers may see currency conversion charges on their card statement.
• Each listing represents a unique physical item. Items held in cart are reserved for 15 minutes.
• Orders are confirmed only after successful payment via Stripe webhook — never via client-side redirect.

6. Authentication and legit check

Our authentication process consists of a photo-based review by our expert team, drawn from the BAPE LEGIT CHECK WORLDWIDE community of 100k+ members. We review submitted photos for authenticity (tags, stitching, labels, hardware), condition grading accuracy, description accuracy, and correct size labeling. This is a photo review — items are not physically shipped to us for inspection.

7. Returns and disputes

• If an item arrives materially different from the listing — wrong size, undisclosed damage, or worse condition than described — contact us within 48 hours of delivery.
• We will review the claim and issue a full refund if valid.
• If a sale is refunded, the 4.99% seller commission is returned. Stripe processing fees may be non-refundable.
• We handle all payment disputes on behalf of sellers using our authentication records as evidence.

8. Prohibited conduct

When using the platform, you may not:

• Threaten, harass, degrade, or intimidate other users
• Post defamatory, fraudulent, or offensive content
• Transmit viruses or any harmful code
• Disrupt the performance or operation of the platform
• Use data mining tools, robots, or scrapers without written consent
• List counterfeit, stolen, or prohibited items
• Circumvent the authentication process
• Create multiple accounts without express authorization
• Complete transactions outside the platform to avoid fees
• Reverse-engineer or decompile any part of the platform

9. Fees and payments

• Sellers: Free to list. 4.99% commission deducted from the sale price when an item sells.
• Buyers: 4.99% authentication fee added to the item price at checkout. Payment processing is handled by Stripe.
• All payment processing is handled by Stripe. We never store card data.
• We reserve the right to modify our fees. Changes apply only to future transactions and will be communicated in advance.

10. Intellectual property

The platform and all its content (design, code, branding, logos) are protected by copyright and trademark law, all rights reserved to K-DEV Solutions LLC. Users are granted a non-exclusive right of access in accordance with these Terms. No element of the platform may be used, reproduced, or distributed without prior written consent.

11. Content and moderation

• You are solely responsible for content you upload (photos, descriptions, messages).
• We may monitor, moderate, and analyze platform activity, including human review and automated detection.
• We may remove content or suspend accounts that violate these Terms at our discretion.
• By uploading listing photos, you grant K-DEV Solutions LLC a license to display and use them on the platform for the purpose of facilitating the sale and authentication.

12. Disclaimer of warranties

The platform and its content are provided "as is" without warranty of any kind. We do not guarantee uninterrupted availability, accuracy of listings, or the outcome of any transaction. K-DEV Solutions LLC acts as an intermediary and is not a party to the transaction between buyer and seller.

13. Limitation of liability

• Nothing in these Terms excludes our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be legally excluded.
• We are not liable for indirect damages, loss of profits, or loss of revenue.
• Our maximum cumulative liability is limited to the amount you have paid to the platform in the 12 months preceding the claim.
• You agree to indemnify K-DEV Solutions LLC against any claims arising from your violation of these Terms.

14. Termination

• You may close your account at any time via your account settings.
• We may suspend or terminate your access to the platform with reasonable notice where required by law.
• Active listings will be removed upon account closure. Pending orders and open disputes must be resolved first.
• Payout history is retained for 7 years as required by financial regulations.

15. Changes to these Terms

We may update these Terms from time to time. Changes that may adversely affect users will be communicated before taking effect. By continuing to use the platform after notification, you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of New Mexico, United States. For any questions: support@marketplace.com
